Legal question?

I got arrested for a PI in Texas. Thing is, they never made me take a walk the line test, no breathalyzer, or blood work. I just spent the night in jail. Now the prosecutor is going to offer me a low amount offer or plead no guilt and take to trial. Some lady said they have nothing on you basically. Should I fight this or just pay? Any suggestions please. I'll answer any questions if you have some.

I'm confused, what was the basis for you getting arrested then?

And what is the prosecutor offering and would it show up on your record at all? If the answer is that it will show up on your record then I'd go to trial if I were you unless they have some tangible evidence on you.

Trial or pay a fine with no record... jay walking etc.
Whatever you pay a fine for is admission of guilt and is on your record for life.
I still have to explain a 1986 minor drinking on my clearance.
Talk to a lawyer...

How much is the fine? Do you have a prior record? How will this affect you in the future, as in does your occupation require a license from the State or a background check? Same question regarding admission of guilt after being read Miranda rights. Too many questions to give you sound advice. Did they offer pre-trial diversion which makes the charge go away if your a good boy for a period of time?

I actually was offered a pre trial that I'm going to right now. I never said I was intoxicated and I wasn't read my Miranda rights. All I said was, "am I being detained?" He said yes. I Jen said I wanted to speak to my lawyer.

same happened to me... they dropped the charges when i showed up to court.. i had plead not guilty.. i was so drunk i dont remember pleading anything...... lucky me... put a fist through some guys apartment window, pissed off a bunch of ppl acting da fool..... volunteered for a kendo stick beating, etc etc..cra cra night.. ahhhh youth.. i did replace the window though

but they never read miranda rights, no breathalyzer, nuffin ... well they threaten to pepper spray me if i didnt shut up...

Might be cheaper/less hassle to take pre-trial diversion and pay the fine, depending on what's at stake. I wouldn't count on the charge being dismissed just because you show up at court.

If I was in that situation, I would be hiring a lawyer, have too much to lose professionally to have PI on my record.

Like others said, talk to an attorney. If they are going to fine you and and it is NOT going to stay on your record then, personally, I'd pay the fine; dependent of course the amount of the fine. If it is going to stay on your record with your paying the fine, I'd be tempted to go to trial if I was confident I could beat it.

Really? Is that legal? I thought if you were arrested/charged you were entitled to a Public Defender regardless.... Judge gets discretion on whether you can afford an attorney I suppose.

Anyone looking for a lawyer that is cheap and good, I have a cousin named Vinny that can help you out. Willing to travel and may be a little rough around the edges but gets the job done.
