Defense attorney James Sultan, while questioning Massachusetts State Police Trooper Timothy Dowd about tire pressure in former New England Patriots tight end Aaron Hernandez's murder trial, asked Dowd, “Did you ever receive training in football deflation devices?” He was very obviously referencing the Deflategate controversy that commanded much media attention in the two weeks between the AFC title game and the Super Bowl, Jared Dubin of CBS Sports reports.

The reference came during Sultan's line of questioning to Dowd about the tire tracks that were found at the scene of the crime. Dowd answered that he had not received training in football deflation devices, after which Sultan returned to his seat, according to CBS' local affiliate in Boston.

As trial resumed on Friday, Sultan said “in hindsight, that was a mistake.” Judge Susan Garsh responded that, "We are here on very serious business," at which point Sultan apologized for the joke and trial continued apace.

Judge rules Aaron Hernandez trophies must be hidden from jurors


FALL RIVER — Defense attorneys for former New England Patriot Aaron Hernandez today went to battle with prosecutors over how police initially investigated the death of Odin Lloyd — and butted heads over what jurors will see when they check out key scenes of the crime tomorrow.

Assistant district attorney Patrick Bomberg requested that Hernandez’s trophies, religious objects and other memorabilia — currently on display in his North Attleboro home — be hidden from the view of jurors who are scheduled to tour the home tomorrow.

Defense attorneys struck back and contended that because Hernandez’s fiancee, Shayanna Jenkins, still lives in the home she can decorate it any way she wants.

“This house is not a museum. People have lived there,” said defense attorney James Sultan.

Superior Court Judge E. Susan Garsh ruled that disputed items should be taken off the walls and all display cases should be covered. She also told prosecutors they have to remove a flag posted at the North Attleboro industrial park. The flag, which was considered inadmissible hearsay, indicates where Lloyd’s body was found.

Earlier this morning, defense attorneys attempted to poke holes in the initial investigation into Lloyd’s murder, indicating that authorities did shoddy work at preserving key evidence.

Sultan asked North Attleboro Police Capt. Joseph DiRenzo why no authorities at Odin Lloyd’s murder scene took out a tape measure to accurately record the distance between his body and nearby evidence.

“Nobody had a measuring tape? Is that what you’re telling this jury?” Sultan asked during cross-examination.

“I don’t think anybody did,” DiRenzo responded.

Multiple photos have been shown of Lloyd’s lifeless body with evidence — including shell casings and a red hat — strewn about. DiRenzo and other authorities have given rough estimates as to how far away the evidence was from Lloyd’s body, but Sultan questioned why there was no official measurement.

He also pointed out that DiRenzo’s testimony that seven officials were on scene before the storm was inaccurate. According to an official report held by Sultan, there were 11 law enforcement personnel on scene.

“There were 11 people on the scene before it started to rain, and none of them had any way to measure?” he asked.

Sultan also asked why Massachusetts State Police Crime Scene Services were not called to the scene. DiRenzo acknowledged that normally evidence at a murder scene would be looked at by that group but said they weren’t immediately called in because “everyone was aware of the storm” on the horizon.

DiRenzo had testified that authorities picked up certain evidence — including shell casings, Lloyd’s hat and a towel nearby — in order to protect it from the storm and preserve potential DNA evidence. Sultan asked whose decision it was to “scoop up” the evidence, while other items were covered with tarps.

DiRenzo called it a “joint discussion.”

Other evidence, including Lloyd’s body and tire treads, were covered with red tarps. Sultan asked why everything wasn’t covered with tarps, and DiRenzo said authorities were afraid certain items – like the bullet casings – would wash away in the rain.

DiRenzo couldn’t say who exactly removed all of the evidence.

Sultan also made reference to the fact that officers shielded themselves from the rain using a canopy that could have been used to protect evidence.

DiRenzo was questioned about his interview with David Swithers – one of the first people to discover Lloyd’s body. Sultan asked whether Swithers had told DiRenzo about “other runners and joggers” who came through the area. DiRenzo acknowledged that the conversation had happened.

One key piece of evidence, which has not been introduced, is Hernandez’s footprints at the murder scene.

I'm sure that all of the prayers of that so very pure of heart a group as the Patriot nation are with their brother, Aaron, as he faces his terrific struggle against the oppression that he has encountered these days. It must be obvious that Robert Graft and company are solidly in his camp to fight strongly with him against these false murder charges and allow him to retain his status as an elite receiver in the NFL. Gee.... I wonder how many of his fellow Pats teammates loved to party with him and hang out with a legit GANGSTA!
