Thats why in my original response I said what the school should have done, was made a policy that would then make the shirt a violation, instead of calling the cops. The school really has no leg to stand on, in this, in my opinion.

Yes, but the family has to pay for a lawyer now, and the school district (taxpayers) too.

Even if they throw it out, who is gonna risk this happening to their kid?

Mission accomplished I guess.

depends. If they go to court and the kid wins (which is the only feasible outcome I can see). Maybe schools administrators wont be so quick to get the law/courts involved.

So what would the school policy be? We reserve the right to send you home if we find anything about your clothing "bad"? IMO an NRA shirt is no different than a Sponge Bob shirt. What's there to be "threatened" by?

Obviously this is more about guns than it is about fashion.

So now we can't eat a pop tart in the shape of a gun,

can't point our finger at someone and say "pow"

can't wear a t-shirt that has the letters NRA on it

Anyone see problems with this?

We are viewing as adults. This is not about right infringement. Doesnt matter if the shirt said NRA: I Love Guns or NRA: Only the Stupid Love Guns.

If there is no school policy, make one. Easy enough.

This is not about some 8 year old or 14 year old trying to make a political statement. It is about general and natural rebellion. Like an 8 year old cares about anything more than Sponge Bob or the 14 year old more about the acne on his face?

I wore a Dead Kennedys "Too Drunk To ****" teeshirt to school. I was told to remove it as it violated school policy. I did not because I AM A REBEL and I made a very eloquent speech about my rights of speech blah blah too. I was given in-school suspension. Parents whooped me. Case closed.

Not the same at all. COMPLETELY different. Profanity on a shirt is disruptive to the other students (probably because they won't shut up about that guy wearing the shirt being so fucking cool)

Schools have a dress code so that what someone is wearing doesn't disrupt the environment of learning. The teacher was COMPLETELY out of line as there was nothing disruptive about the shirt.

If the school can't clearly define what is acceptable, and what is not, then they should force uniforms. Each teacher shouldn't have the ability to arbitrarily decide what they find offensive on any given day when it comes to clothing in the classroom.

Here's a crazy thought how about not giving a **** what T-Shirt a kid wears and be more concerned about educating them. Trust me the next generation is a bunch of dumb fucks, I know a few of them, they are dumb.
