Sadly, if it can't be code audited independently to confirm, I would say that is true for all devices in general to varying degrees.
What makes TVFrog stand out from a trust standpoint is that Kodi's official maintainers cut off support at Android 5 and TV Frog claims Android 4.4. So in this case, I would say that's more of a dead giveaway. It's not like the work to polish a platform and interface under ONE version of android wouldn't be hard to update to newer versions. So the fact they are stuck on anything older than 6(which still is still maintained) means they really polished the spyware structure to be unnoticeable and newer versions of android fixed those exploits.
