They, again, would not have to prove that a concussion existed. They would have to prove that process was not good enough to diagnose the concussion.
Tua wasn't diagnosed with ataxia because it wasn't part of the protocol at that time. It was when Bridgewater was diagnosed.
I think there are plenty of lawyers who would take this case, but I also think it wouldn't be a slam dunk win. Although I do think the NFL would probably not want to go to trial because of the bad publicity.
Anyway, I'm done being a lawyer for the day if you are.
Tua claimed his stumblimg was not neurological but his ankle and back so no guarantee the doc would have concluded it was ataxia given other non-neurological injuries could explain the stumbling.
