I think he could prove that harm resulted though - and Tua can't prove he had a concussion, but what he can prove is that he had symptoms that league decided a week later were symptoms of a concussion. The league's decision to make those symptoms "No go" seems like proof of that.

The follow up concussion he received on the Thursday night game seems like pretty good proof that harm resulted. That's what led to the firing and change of process, iirc.

The hit on Thursday night clearly could have caused a concussion in its own right. Also not sure Tua technically experienced ataxia since he said it was his back or ankle. When they used ataxia to rule out Bridgewater it was because despite passing the concussion tests Bridgewater still had ataxia. Tua did not.

"Bridgewater left the field and was escorted into a medical tent, considered questionable to return as he was evaluated for a head injury. Later, it was reported Bridgewater passed his concussion tests, but the spotter saw the quarterback experiencing ataxia, ruling him out for the rest of the game."


It was also ultimately determined Bridgewater never actually had a concussion despite the Ataxia.


So Ataxia is a precaution. It doesn't actually prove a concussion existed and the NFL would be able to point to real cases to prove that fact. The standard of evidence in a court case would not be met IMO. This isn't something you can just guess at or assume when you talking about potentially awarding someone tens of millions.

They, again, would not have to prove that a concussion existed. They would have to prove that process was not good enough to diagnose the concussion.

Tua wasn't diagnosed with ataxia because it wasn't part of the protocol at that time. It was when Bridgewater was diagnosed.

I think there are plenty of lawyers who would take this case, but I also think it wouldn't be a slam dunk win. Although I do think the NFL would probably not want to go to trial because of the bad publicity.
