So let's chart this out. They scream horrible things at your wife. Instead of recording it and calling security, you throw the first punch. You're obviously a superhero so let's say you "take a few of them with you." But this is the real world and no one, no one, can fight against a mob. Someone wraps their arms around you and you starting eating punches. You're now unconscious on the ground and being kicked repeatedly in the face for who knows how long. Want to know your chances for permanent, life-changing brain damage? It's a lot higher than you actually "taking a few of them with you." After a month, you finally awake from a coma. Let's pretend you haven't lost your ability to speak and still have basic understandings of who you are. Your first piece of mail is a medical bill that's larger than three lifetimes of working. Your second piece of mail is a summons from criminal court for the battery of many people during the football game. Dozens of eye-witnesses agree that you threw the first punch. They also all agree that it was you who were trash talking and making insults. You have no recording to prove them wrong. The only recordings are ones that started after you threw the first punch, showing a dumbass starting a fight against a crowd. You're looking at years in prison. And you're probably going there because you're guilty and the evidence is overwhelming. The next piece of mail is a summons to civil court. All of those people you "took with you" are now suing you in civil court for medical bills and pain and suffering. Probably millions of dollars (this jury will be people from Philly and you are the out of state jerk that came to the game looking for a fight, in their view). And you're going to lose because you are liable. You've also been fired from your job for acting like a lunatic and starting a brawl at a football game (assuming the mental an physical injuries you sustained after being beaten to hell by a mob haven't rendered you unable to do your job in the first place)...
When I look at all this, I think the guy who actually recorded the asshole fans and restrained himself from escalating a terrible situation seems like more of a man to me. And he's definitely smarter because he's getting the last laugh on this guy in a major way. Honestly, I hope his wife is already contacting lawyers about the civil assault she endured at the game (conveniently recorded on his cell phone). I'd also bring in the football stadium (where the real money is) because just where exactly was security during this? Will they win in court? Well, the asshole fan is dead to rights. The only question is whether or not there was reasonable fear for the woman. The stadium? Probably not but it's possible the stadium will want the mess not to go to court and offer a settlement, in which case, take the free money.
Thank you for the fun thought experiment.
* Assault might sound strange because the asshole Philly fan never touched the wife. What I'm talking about is Civil Assault which is different from Criminal Assault. Civil Assault is defined as:
"any intentional act that is meant to cause a "reasonable apprehension of imminent and harmful contact"—that is, an action that made someone (the victim) expect that they were about to be hurt or, at least, touched in a potentially harmful way by the offender. In most states, the victim's apprehension or fear of imminent harm—as long as it's a reasonable response to the situation—is all that's necessary in order for an act to be considered an assault under personal injury law. The specific legal requirements vary by state."
