“The other driver refused EMS, but drove himself to the hospital due to back pain.”

This will cost Jay a bit.
The other guy said he did not need medical care and then decided “oh yeah I need to have back pain for a real payout.”

Good luck with that.

we dont have many gun laws here...you can pretty much do whatever the **** you want with a gun in this state. not sure about diving drunk with a handgun...i dont think there is much of a charge there since you can have a gun in your car without needing any sort of permit or anything, but i could be wrong.
You definitely can’t have a loaded gun in the car without a permit, and if you’re carrying while intoxicated even with a permit you’re fucked…

He’ll win that. They argue you don’t feel the pain in the moment cause things tense up and adrenaline. You can have symptoms pop up days later and still win the case.

That said, unless the person is very seriously injured, it won’t cost Jay anything. The guy will go to some hack chiro for 8 weeks and get his neck popped and do some knee raises and they’ll bill the insurance 10-20k… lawyers and doctors will take 75% of it.

Fucked?? No, not fucked

Tennessee has permit-less carry, so you can have a loaded gun in your vehicle without a permit

It is a class A misdemeanor for being intoxicated with a gun. He will pay a fine for the gun charge part and that will be it

The DUI is much more of an issue for Jay than the gun is

I guess they’re more relaxed since I got my carry permit. Used to not be able to have loaded rifles in the car either.

2k is a stupid offer. Probably costs that much to fix the car.

The question is how much does avoiding the public embarrassment and potential income loss matter to Jay? You gotta offer the guy like 10k at least.

You could easily argue it’s worth giving the guy 100k. If I’m the other driver that’s what I’m doing. I’d settle for less, but that’s my number.

He doesn't have touch.

Final answer.

Probably felt weird about his vibe and presenting the offer as too good to pass up. Shady smirk looking like Kyle Orton on a Friday night.

"Nah this dude can go sleep this off with a toilet paper pillow."

Should have offered 10,000-20,000.
2,000 is like a wash just for fees and classes.
Then Time, publicity, opportunities.

Probably worth $50k or worse to Cutler in the end.
One TV show long term gig he doesn't get and it's worse than that.

Maybe he had Cliff Stein make the offer?
