So my wife got told that since Progressive can't collect payment from the other insurance company, she has to testify at trial or it will be dismissed and they will come after us for uncollected damages. We weren't at fault, paid the deductible anyway, and now this. **** you, Progressive

Thats a shame Ole..Id see a lawyer and sue the bastards

It's in the policy but doesn't make it any more reasonable. I'd go for her but I wasn't in the car at the time of the accident because we work on opposite sides of the city. So my insurance doesn't insure me against pigfuckers whose companies won't pay? We're not even with progressive any more because see OP.

My girlfriend hit someone Tuesday. She has Geico and when she reported the accident after getting home, she didn't even have to talk to anyone. She just had to listen to a robot ask questions and select the closest answer on her phone which I thought was weird.

Anyways, hope shit works itself out, ole.

If the other guys insurance didnt pay Ole..Your uninsured motorist insurance should kick in. Then they sue the other insurance company

OK...I was under the impression that even if he was insured the uninsured motorist ins would kick in cause they refused to pay...But I see they are just going straight to court with it. I hope they return your deductible after they collect

Dealing with Nationwide right now, my friend rear ended me last week, so far no real problem outside of how slow they took to call me, but as of right now I call I show up they say it's drivable or not if not I get a rental if it is I drive it till they work on it, and then last year i back into a car pulling out of a parking spot (didn't see the woman driving) and Safeco (my insurance) handled it pretty hastely.

I thought so too but it's on me for not reading the fine print. Their point is the company, not the individual at fault, is refusing to pay, and I think they're trying to make an example of them. All I know is we have no choice as plebs but to go and testify, unless we want progressive to sue us for payment for an accident where someone else was at fault.

also, even if I had read the fine print, the policy's the same for most insurance companies I'm aware of. so what do you say? no, thanks, I don't like that clause, I will just go without insurance. Fucking rigged.

I figured there might be some subrogation enthusiasts out there on this board, but I guess not.
