Maybe; maybe not. Maybe the state medical examiner says, "**** that. No special treatment." Or maybe she says, "Let's end this shit sooner rather than later." Who knows?
Someone else mentioned the Kobe Bryant case and asked why that moved so quickly. No idea, but I suppose it could be because investigators believed they had enough external factors and additional evidence for probable cause and forward to the prosecutor without waiting for tests to fully get back. Generally speaking, once you arrest someone, the evidence-gathering is supposed to be complete. It would make sense in a case where you might not believe there's enough evidence yet for a conviction to wait for test results to get back before filing paperwork to the prosecutor and before the prosecutor wants to stick his neck out by filing official charges.
Of course, this is all conjecture and I'm not familiar with Colorado or New York law.

I have a pretty good alibi as all I'd have to do is show the Feds this forum and my posts and they would probably agree that due to the stupidity going around in here I would have needed to search that in order to provide information.
Then they'd probably ask why I would want to discuss this with so many fucking morons...

The real question here is even with a rape kit do they have his DNA for a comparison, and with no charges I don't think they can compel him to supply it, so has he given it willingly. I don't think there is any reason to supply it without charges which could be another reason for a slowdown maybe. All speculation on my part but I wonder how that works. It's not like TV where they give him some water at the station then send the cup to the lab.
