That's correct DBQ. Each side makes its demand and if no resolution is agreed before the hearing date, it goes to hearing where each side puts on its evidence about the value of the player. Like any evidentiary proceeding, certain things are admissible as evidence and certain things are not. The player, if he wants to stay in the league, must accept the arbitrator's award (i.e. the salary adjudicated to be proper). If the team does not accept the award, it can walk away and the player becomes a UFA.
In this market, Zito's hardball could come back to bite Niemi in the ass. Because if the Hawks walk away from an award they deem too steep, there is a substantial risk that Niemi floats out in UFA-land like so many UFA's this year. Nabby just signed in the KHL. Based on what Ellis, Leighton, et al. got, good luck on the open market this year, Niemi.
