In a Civil Trial, they can be forced to testify if Disney were to argue that primary culpability lies with the parents. Civil Trials have different rules than Criminal Trials.

Not if there is any danger that a witness refusing to testify could be prosecuted in any criminal case later. For example, say Disney wants to try and prove that the parent was the blame for failure to protect their child adequately and were culpable. Then the state could prosecute the parents for child endangerment and move to take any remaining children from them or actually level other criminal charges against them.

So what do you think happens at a movie night?

And how was this gator able to snatch this kid if the parents were standing right next to him?


Gee. what happens? People go to a movie to watch a movie. You do not know even if they were even watching that movie. Maybe the movie was over? Maybe the movie didn't start yet? Maybe they thought that the movie sucked and left. There is no evidence at all that those parents were away from that kid while watching a movie. Nothing at all.

You have to admit, having a movie night on the beach by a lagoon with alligators at night is probably not a great idea. Almost as bad as taking your eyes off a 2 year old near water.

Disney needs signs at their outdoor movie nights that say "Parents are expected to watch and protect children at all times"

I don't know ares. I don't know exactly where the movies are shown at this resort. But if it is on the beach, I'd have to say it's a dumb idea to have families watching a movie on the beach near a lagoon with potential alligators, at night.

Again though, taking your eyes off a 2 year old near water, especially at night is monumentally dumb, regardless of gators.

Movie night is put on by the hotel. Guests are invited to the beach to watch movies and fireworks.

They can still be called to the stand and if they plead the 5th and are not willing to explain what happened that night it would impede their ability to prove their case particularly if Disney can produce witnesses that testify they were in fact watching a movie while their kid was splashing about at the Lagoon.

And if no criminal case is being contemplated then like OJ Simpson they would not be able to plead the 5th in a civil case.

The evidence that they were actually watching the movie is that their kids was snatched by an alligator.

Yes I know that. Doesn't thatake change the fact that most likely the parents were distracted whether it be by movies, fireworks or the starry night.

There is very litalented reason to think these parents were in between this kid and the gator which is where they would need to be if they wanted they kid playing in water at night.

I sure as heck have walked along the beach in ankle deep water out here all of the time with no swimming signs posted. This family was not swimming in the water. Nobody has shown anything of the kind. I just do not see how that resort could not post simple warning signs to protect the tourists is all. I think that probably some penny counter decided to save a few bucks or some exec decided to not SCARE the tourists by the use of proper warning signs never thinking that something like this could ever happen.

Enjoying a Movie Night means that the parents were watching a movie some distance from their kid? Do you know how stupid that statement is? Want to think about that for awhile and say something different? I can also see this conversation. Back in Nebraska, two parents are talking and one turns to the other and says....."Hey hon, lets go to a movie tonight and leave the kid in the parking lot to fend for himself"? I will bet a lot of money that those parents were not watching some movie and leaving a two year old kid like that. No one would do that!

Hawks have you seen how parents interact in public now, close to 60 - 70 percent of the time there are kids running loose in public without a parent around. Different generation from yours, parents are more worried about a fucking cell phone than their own kids.

So you're saying he would probably be the equivalent of a Kicker or Punter. Maybe that was the problem. He should have kicked the alligator's mouth open.
